近期,國外某些公司濫用知識產權,向中國公司生產并出口至國外的竹地板產品的經銷商散發函件,無理指控上述竹地板產品侵犯所謂美國第5543197號專利權及在其他國家的同族專利權,這是典型的不正當競爭行為, 本會謹嚴正忠告國外某些公司,請立即停止散發該種函件的不正當威脅行為。否則,我們將不得不采取正義的法律行動, 依法維護公序良俗和市場環境。
中國林產工業協會竹材專業委員會包括四十多家中國竹產業企業,還有南京林業大學、浙江林學院等多家大學和科研機構。
本會早就全面分析了美國第5543197號專利及在其他國家之同族專利的詳細內容,并且查實完成于上世紀九十年代初的美國第5543197號專利的專利申請日為1994年2月18日。我們同時進行的相應專利檢索清清楚楚表明:僅僅中國專利局1989年11月22日授權的第88102689.1號“一種竹膠積成板的制造方法” 中國發明專利(由中國龍游縣壓板廠1988年5月3日提出專利申請),就與該美國第5543197號專利屬于同一技術方案。同時,中華人民共和國林業部為規范竹材重組材類產品17173的質量,于1992年9月9日頒行的包含上述技術方案的中華人民共和國林業行業標準LY/T 1072-1992“竹篾積成膠合板技術條件”、LY/T 1073-1992“竹篾積成膠合板物理力學性能測試方法”。該兩項標準實施10年后,重新修訂合并為LY/T 1072-2002“竹篾層積材”標準,于2002年10月12日發布并實施。中國利用該技術方案生產竹材重組材類產品已有20多年的歷史,因此竹材重組材技術在前早已屬于公知技術,重竹地板只是利用該技術生產的一種產品而已。
1994年2月18日美國第5543197號專利申請提出時,同樣的技術方案至少在前已在中國公開,該專利申請已經完全喪失了新穎性。無論根據美國的專利法,還是根據中國的專利法,或者根據其他主要國家,例如澳大利亞、西班牙、墨西哥等國家的專利法,喪失了新穎性的技術方案即使被授予專利權,也是混進去的“假性專利權”,依法應當宣告無效。某些居心不良的國外公司借以威脅的美國第5543197號專利及其在世界各國的同族專利正是這樣一個實質上是無效的、依法應當被無效的“假性專利”。本會早已公開闡明這一情況,國外某些公司也理應知曉這一情況。遺憾的是,國外某些公司仍然明知故違,不顧事實真相,惡意指控中國公司生產并出口至美國或者其他有關國家的竹地板產品之經銷商侵犯其專利權,國外某些公司的這種行為已經構成不正當競爭。
本會嚴正聲明,請立即停止散發該種函件的不正當威脅行為。本會和相關權益人保留進一步追究國外某些公司相應法律責任的權利。

STATEMENT
Recently, some foreign companies have sent letters to the dealers of Chinese manufacturers of bamboo
flooring, being exported to foreign countries, alleging that the above bamboo products infringe the
No. 5543197 American Patent and its family patents in other countries. For this conduct typically
constitutes unfair competition, this association hereby advises the foreign companies stop the unfair
threat of sending such letters, and otherwise we’ll take legal actionsagainst these foreign companies,
for their bad faith in business ethics and constitution of patent abuse and unfair competition.
This association is the branch of CNFPIA (China National Forest Product Industry Association), whose
members including over 40 Chinese companies in bamboo processing industry, Nanjing Forestry University,
Zhenjiang Forest College and other scientific research institutions. This association have analyzed
the all-round information of the No. 5543197 American Patent and its family patents, and found that the
No. 5543197 American Patent was filed on Feb.18,1994. By patent searching, we’ve also found that the
Chinese patent (No.88102689.1) of “a process of making parallel bamboo strand lumber”, which was filed
on May 3,1988, is identified with the above U.S patent. Moreover, Forest Ministry of PRC issued PRC forest
industry standards LY/T 1072-1992 of “Technical Qualifications of Parallel Bamboo Strand Lumber” and
LY/T 1073-1992 of “Test Method for Physical and Mechanical Performance of Parallel Bamboo Strand Lumber”
on Sep. 9, 1992, in order to control the quality of the recomposed bamboo strand lumber products.Ten years
later, the two standards were revised and formed one standard, that is, LY/T 1072-2002 of “Parallel Bamboo
Strand Lumber”, which was issued and came into effect on Oct. 12, 2002. Chinese enterprises therefore have
used this technology to manufacture recomposed bamboo strand lumber products for over 20 years, and the
recomposed bamboo strand lumber technology have been public and prior art, in which the recomposed bamboo
flooring is just one of the products using this technology. Therefore, before the date Feb.18,1994, the same
invention had been public and became prior art to the above U.S patent, that is, the U.S patent has no
novelty. Though having been granted patent right, an invention without novelty is an illusory patent that
should be invalidated legally, in any event, according to American Patent Law, Chinese Patent Law or that
of other countries. The No. 5543197 American patent on which the foreign companies’ threat based actually
is an illusory patent and would be invalidated legally. This association has set forth it, and these foreign
companies should have waked up to it before their allegation of the No. 5543197 American patent as well.
Rather, it’s a pity that these foreign companies misuse the patent right knowingly by sending a number of
“notices”, alleging in bad faith that the dealers of Chinese manufacturers, exporting the bamboo products
to the USA, have constituted patent infringement, and these foreign companies have committed unfair competition.
This association hereby seriously states that these foreign companies should stop the unfair intimidating
conduct. This association and entities concerned retains the right to take legal actions.
